Terms & Conditions

Before using or accessing our Affiliate Progam, please read this Policy page carefully!

1. Overview

This Agreement governs your participation as an affiliate (“you” or “Affiliate”) of Merchize.com (“Merchize,” “we,” “our,” or “us”).
Its purpose is to define the relationship between you and Merchize in promoting our print-on-demand platform and catalog through approved affiliate links, and to explain how commissions, rights, and responsibilities are managed.

2. Eligibility & Joining the Program

2.1 Who Can Join

You may join if you are:

  • An individual aged 18+ with legal capacity, or
  • A business or organization represented by an authorized individual.

Eligible partner types include:

  • Agencies managing multiple stores
  • KOLs, influencers, educators, and POD experts
  • Platforms, tools, or apps integrating or referring Merchize

2.2 Application & Approval

  • Applications are reviewed case-by-case.
  • Merchize may accept, reject, or terminate applications at any time.
  • We do not accept affiliates whose content or traffic involves:
    • Adult, violent, discriminatory, fraudulent, or illegal content
    • Copyright or trademark infringement
    • Misleading or false claims about Merchize
    • Domains or social handles containing “Merchize” or confusing variations

       

2.3 Affiliate Dashboard Access

Affiliates must maintain accurate contact, payment, and tax information. You are responsible for account security. All activity under your account is considered yours.

Once approved, you’ll gain access to your affiliate dashboard where you can track performance, generate links, and request campaign support or custom tracking.

You are responsible for maintaining accurate and updated contact, payment, and tax information (if necessary) within your affiliate account. You are solely responsible for the accuracy and maintenance of your custom information and for all other materials/links that appear on your dashboard or profile.

3. Tracking, Cookies & Attribution

3.1 Affiliate Links

You will receive a unique affiliate URL. You can create QR code, shorten it or use an overlay tracking link over this URL.
You may promote Merchize through websites, blogs, videos, social channels, newsletters, webinars, courses, or integrated apps.

3.2 Cookie Duration

  • Default cookie lifetime: 90 days (unless notified otherwise).
  • Users must sign up or create a Merchize account during the cookie period to be counted as your referral.

3.3 Attribution Model

  • Merchize uses last-click attribution within the valid cookie window.

Last-click model: Your referred users might bounce off Merchize.com, then visit through another affiliate url, this action will overwrite your affiliate ID with the new one.

4. How Commissions Work

4.1 Commission Earnings

  • Earn up to 19% commission on every fulfilled item sold by referred merchants.
  • Commission period: 180 days following the date of their first fulfilled order.
  • The commission would be based on the reward of the specific Variant SKU ID on the fulfilment order creation date.

4.2 Commission Base

Commissions are calculated on:

  • Variant SKU ID: product in Merchize’s catalog, separate by size, type & other variant, would have their own distinct ID number, with their own fixed affiliate reward.
  • The order creation date is within 180 days of the first sales made by referred merchants.
  • Example: https://merchize.com/product/pet-pillow-case/ 
    • Custom shape Plush Pillow Case size 16x16, variant SKU PPLCVN000000DA04: fixed affiliate reward is $0.5 or 11% commission rate (over $4.5 item cost)
    • Custom shape Plush Pillow Case size 24x24, variant SKU PPLCVN000000DA07: fixed affiliate reward is $0.5 or 11% commission rate (over $5.5 item cost).

Commissions do not apply to:

    • Products are outside of the Affiliate Program.
    • Shipping fees
    • Taxes or transaction fees
    • Merchize’s compliment orders: consisted of 100% cost covered vouchers or discounts, usually in the context of sample or test orders.
    • Canceled or refunded orders
  • Self-referrals
  • Campaigns/products marked as non-commissionable

4.3 Self-Referral (Strictly Prohibited)

You may not earn commissions from:

  • Your own stores
  • Stores sharing the same legal entity, payment method, tax ID, email, or owner
  • Internal/demo brands or private stores you operate

     

If self-referral is detected:

  • Merchize may void all related commissions
  • Fraudulent activity may result in immediate account termination

4.4 Merchize’s complimentary orders:

Merchize also put a lot of effort into supporting new print-on-demand sellers to kickstart their online selling journey, we provide them with diverse offers including discount vouchers, free samples & partner deals. To prevent abuse to the system, you may not earn commissions from:

  • Orders purchase with 100% discount value (ie. free sample vouchers, testing vouchers…)
  • Orders made by the Merchize team for the sellers stores. (ie. ordering sample products for a photoshoot…)

5. Payouts

5.1 Payout Schedule

  • Commissions are shown in near real-time on the dashboard
  • The payout amount would be calculated monthly, on the 1st day of the following month.
  • Commissions will be paid on the 15th of the following month via PayPal.
  • Only completed and non-refunded orders are eligible.

     

5.2 Minimum Payout

  • Minimum withdrawal amount: $20 USD.
  • Transaction fees may be deducted by Paypal, when you withdraw money to your bank account.

     

5.3 Refunds After Payout

If an order is refunded or canceled after commission has already been paid:

  • Merchize may deduct that amount from future payouts, or
  • Request repayment, depending on policy and severity.

     

5.4 Inactive Balances

If no withdrawal request or valid payment information is provided for 12 months, Merchize may void unpaid balances.

5.5 Taxes

Affiliates must comply with tax laws in their jurisdiction. Merchize may withhold tax where required.

6. Content, Advertising & Compliance

6.1 Content Accuracy & Disclosure

  • You must clearly disclose your affiliate relationship based on in your local jurisdiction (FTC or local equivalent).
  • Content must avoid misleading claims.

6.2 Use of Merchize Brand Assets

You may use Merchize logos and images only to promote Merchize.
You may not alter, misuse, or present yourself as an official representative.

6.3 Prohibited Traffic & Advertising

Not allowed:

  • Spam emails, spam comments, spam messaging
  • PPC bidding on “Merchize” or close variations
  • Domains or pages impersonating Merchize
  • Posting affiliate links on uncontrolled coupon/deals sites without approval
  • Direct-link paid ads (if restricted at certain times)
  • Creating fake/unapproved Merchize fanpages or groups

6.4 Prohibited Technical Behavior

Strictly forbidden:

  • Clickjacking, linkjacking, cookie stuffing
  • Forced redirects, pop-ups/pop-unders
  • Automated or fake clicks
  • Typosquatting or brand hijacking

6.5 Prohibited Content

  • Hate speech, violence, or discriminatory content
  • Adult/explicit content
  • False claims about product features, pricing, earnings, or shipping
  • Editing or misusing Merchize brand assets

Claiming to be “official”, “exclusive partner”, or “legal representative” without written agreement

7. Merchize’s Rights

7.1 Monitoring

Merchize may review your content and traffic at any time to ensure compliance and request adjustments.

7.2 Program Changes

Merchize may update commission rates, program structure, tracking rules, or terms at any time.

  • Any updates to the commission rates, how the program is structured, tracking guidelines, or the main terms and conditions will be communicated to you at least 15 days in advance. This notification will be sent via email or posted on your dashboard.
  • Changes to the price of items and rewards may happen automatically and without prior notice. This is necessary to immediately reflect fluctuations in the cost of stocking the items, or any changes in taxes and fees incurred during production and logistics.

Continued participation = acceptance of new terms.

7.3 Termination

Either party may terminate the partnership at any time via written notice.
If you violate policies, Merchize may:

  • Terminate immediately
  • Forfeit unpaid commissions
  • Deduct fraudulent commissions
  • Block future participation

8. Data Privacy & Confidentiality

8.1 Customer Data

All seller and customer data (names, domains, contacts, order details) belong to Merchize and the customer.

Merchize does not share:

  • Seller identities
  • Store domains
  • Contact information
  • Personally identifiable order information

     

Affiliates may see:

  • SKU Variant ID
  • Anonymized referral counts
  • Aggregated revenue and commission data

8.2 Confidential Information

Any non-public data shared by Merchize must remain confidential and used only for promoting Merchize.

9. Liability & Indemnification

9.1 Limitations Liability  

To the fullest extent permitted by law, Merchize shall not be liable for any indirect, incidental, or consequential damages (including lost profits, income, or data).

Merchize's total aggregate liability arising from this Agreement shall not exceed the total commissions unpaid to you during the 180 days prior to the claim.

9.2 Indemnification

You shall be solely responsible and liable for, and agree to indemnify, defend, and hold harmless Merchize (and its officers, directors, and employees) from and against any and all claims, disputes, liabilities, damages, and losses (including reasonable legal fees) arising from:

(a) Your content, marketing channels, or business activities;
(b) Your violation of any provision of this Agreement; or
(c) Your failure to comply with any applicable laws or regulations.

10. Relationship Between Parties

10.1 Independent Status

You are an independent contractor. This Agreement does not and shall not be used to create any relationship of:

  • Employment (Employer/Employee)
  • Agency
  • Legal Representation
  • Joint Venture
  • Partnership
  • Exclusive Relationship

You have no authority to make any commitments or statements, assume or create any obligation, or incur any liability on behalf of Merchize.

10.2 Compliance and Responsibility

  • Legal Compliance: You are solely responsible for ensuring that your marketing channels, promotional activities, and all related business operations comply with all applicable laws and regulations in your country or territory, including, but not limited to, laws regarding advertising, e-commerce, and personal data protection.

Vietnam-Specific Regulation: If your content is in Vietnamese or actively targets the Vietnamese population, you must strictly comply with Vietnam's regulations on advertising, e-commerce, and personal data protection.

11. Governing Law

11.1 Governing Law & Jurisdiction

This Agreement is governed by the laws of Vietnam.

Any dispute arising out of or in connection with this Agreement shall fall under the exclusive jurisdiction of the courts of Hanoi, Vietnam.

11.2 Dispute Resolution

Should a dispute arise under this Agreement, particularly regarding discrepancies in sales data, commission calculations, or other tracked metrics, the following procedure shall apply:

  • The Partner must formally initiate a dispute by sending an email detailing the issue to: [email protected].
  • Merchize commits to acknowledging and responding to the dispute notice within three (3) business days.
  • Merchize's system data and statistics, as recorded in the system logs, shall be the sole and conclusive evidence for resolving disputes related to figures, orders, and commissions.

While resolution times may vary based on complexity, we aim to use our best efforts to resolve all disputes within ten (10) business days.

Merchize reserves the right to make the final judgement on all matters subject to this dispute resolution process.

12. Entire Agreement

These Terms represent the full understanding between you and Merchize regarding the Affiliate Program and replace all previous communications.
If any part is invalid, the remaining sections will continue in effect.
